Performance Guarantee:
Global Presence Enterprises, LLC ("Global Presence") offers a performance guarantee for clients who adhere to the terms of our proposed 12-month marketing plan and utilize our data monitoring tools. We guarantee that we will generate a minimum number of qualified leads or achieve a specific Return on Investment (ROI) within the 12-month period of our agreement. Quarterly goals will be established based on the industry and contribute to the overall success metrics evaluated at the end of the 12-month period.
Suppose Global Presence fails to meet the agreed-upon minimum qualified lead goals by the end of the 12 months. In that case, Global Presence will extend its services at no additional labor cost for three (3) months (from month 13 to month 15) to achieve the minimum goals. This guarantee is contingent upon the client's full compliance with our strategic recommendations and the absence of external factors that could adversely impact lead generation. These factors include, but are not limited to, brand awareness, customer satisfaction, sales processes, online reputation, and other relevant considerations.
Client Obligations:
Clients are required to diligently execute the advice and strategies provided by Global Presence. Failure to address or mitigate factors that negatively impact lead generation, as outlined by Global Presence, may void this performance guarantee. The success of the marketing efforts is a collaborative process, and any issues within the client's control must be managed effectively to ensure the desired outcomes.
Acceptance:
By accepting the proposal or contract or by making payment on the invoice, the client ("Client") expressly acknowledges and agrees to these terms and conditions. This acceptance is indicated by selecting the "I Agree to the Terms and Conditions" checkbox or by paying the invoice, which signifies the Client's understanding and acceptance of all legal responsibilities outlined herein.
Limitation of Liability:
Global Presence shall not be liable for any failure to meet the guaranteed metrics if such failure is due to factors outside Global Presence's reasonable control, including, but not limited to, the client's failure to follow advice, changes in market conditions, or unforeseen external factors.
Governing Law:
This Agreement and the performance guarantee are governed by the laws of the State of Florida, and any disputes arising under this Agreement shall be resolved in the state or federal courts located in Florida.
By accepting these terms, the Client agrees to be bound by the terms and conditions set forth by Global Presence Enterprises, LLC.
